ON AMENDING AND SUPPLEMENTING THE LAW NO. 2003/24 ON SPORT


Assembly of Republic of Kosovo,

Based on Article 65 (1) of the Constitution of the Republic of Kosovo,

Approves


LAW ON AMENDING AND SUPPLEMENTING THE LAW NO. 2003/24 ON SPORT

Article 1

Article 1 of the basic Law shall be reworded as following:

By this law there is regulated the organization, terms and manners of development of sports
activities, rights, duties and responsibilities of their holders, sports competitions, financing,
supervision and other importance issues for these activities, particularly the establishment,
registration and management of sports organizations.

Article 2

1. Article 5 of the basic Law paragraph 5.1.shall be reworded as following:

Based on this law, sports activity is considered sportive education and sports activities oriented
in achieving results in sports competitions as well as:

2. Article 5 of the basic Law, paragraph 1, points of this paragraph remain unchangeable.

Article 3

Article 10 and 11 of the basic Law, the noun phrase "Public and Kosovo interest’’ shall be
replaced with the noun phrase ”National public interest."

Article 4

1. Article 19 of the basic Law paragraph 19.1. shall be amended and reworded as following:

19.1. The respective Ministry for Sport shall, in cooperation with the Kosovo Olympic
Committee, Sports Federations and other competent institutions, draft the Strategy on
sport development and action plan and proposes to the Government its approval.

2. Article 19 of the basic Law after paragraph 19.3. there are added two new paragraphs 19.4.
and 19.5. with the following text:

19.4. With the Strategy on sport development and action plan there are determined the
duties and responsibilities of central and local bodies of the Kosovo Olympic Committee,
of the Paralympics Committee, of the Deaf Sports Federation of the sports Federations
of Kosovo and sports associations.

19.5. The determined bodies according to paragraph 19.4 of this Article shall report in
writing to the respective Ministry for Sport on the realization of assigned tasks within the
terms determined in the Strategy on sport development and action plan.

Article 5

Article 20 of the basic Law shall be amended and reworded as following:

Aims and objectives of organization of sports activities are:

- spreading and development of sport for all;

- the continuous increase of the quality of the professional sport;

- the structuring of sports organizations, aiming to specification on public and state
function of the sport;

- using of the best modern experiences, aimed at internationalization of sports of Kosovo
and its integration into European and world sports.

Article 6

The title of Chapter V ‘’ Kosovo Olympic Association ’’ shall be replaced with the text ‘’
Olympic Committee of Kosovo’’.

Article 7

Article 21 of the basic Law shall be amended and reworded as following:

21.1 Olympic Committee of Kosovo is the highest sports non-governmental institution, where
joining sports federations, sports associations and other associations, whose activities are
important for the development of sport in accordance with the statute and its regulations.

21.2. Olympic Committee of Kosovo establishes conditions for the unimpeded development of
sport and Olympic movement in the Republic of Kosovo and is independent in its activity.

Article 8

Article 22 of the basic Law shall be amended and reworded as following:

Kosovo Olympic Committee operates under the principles of the Olympic movement, of the
Olympic Charter and Olympic movement needs. The Olympic Committee of Kosovo with their
acts determinates their internal organizations, functioning and manner of the work, membership
and manner of implementation of the rights and obligations, manner of use and protect of the
symbols and signs of the International Olympic Committee and Olympic Committee of Kosovo.

Article 9

Article 23 of the basic Law shall be amended and reworded as following:

23.1. Kosovo Olympic Committee promotes and follows the development of sport in the Republic
of Kosovo, as well as:

- participates in proposing and realization of measures for the advancement and
development of sport;

- contributes and participates in organizing of the Olympics games and other
international sports competitions, determinate nomenclature of sports, coordinates the
activities of sports federations, sports associations for the realization of the Strategy
on sport development and action plan;
- acts in collaboration with the Faculty of Sport Sciences and other relevant institutions
in the advancement of scientific work in Sports and helps in training and progress of
professional staff;

- contributes to achieving of the height results of the Kosovo athletes and their
participation in national sports teams in the Olympic Games in European and world
championships and other International competitions;

- helps connection of the Republic of Kosovo through sport with other countries for the
greater approach with other nations, peoples, for approaching the athletes and other
participants in sports events.

- is engaged in spreading the Olympic principles and ethical, moral norms in sport as well
as protecting the symbols and signs of the International Olympic Committee and
Olympic Committee of Kosovo.

-represents the sport of Kosovo before the International Olympic Committee, sports
Organizations and relevant international association in the framework of the Olympic
movement.

23.2. Statutes of the members of the Olympic Committee of Kosovo must be in accordance with
its statute.

Article 10

Article 24 of the basic Law shall be amended and reworded as following:

24.1. Financial Funds for operations of the Kosovo Olympic Committee, until to the recognition by
the International Olympic Committee, are provided by Kosovo Budget through the respective
Ministry for Sport.

24.2. Activities of the Kosovo Olympic Committee are supported financially by the relevant
Ministry for Sport and by other resources provided by this Law.

24.3. Republic of Kosovo shall recognize only one Olympic Committee of Kosovo and
no other organization can not accept the authority of the Olympic Committee of Kosovo.

Article 11

Article 25 of the basic Law shall be amended and reworded as following:

25.1. In the framework of the Kosovo Olympic Committee, as an independent body for arbitration
in sport, operates the Council of Sport Arbitration and Sport Arbitration Court for resolving
disputes related to sports.

25.2. Council of Sport Arbitration decides for request and extraordinary review of the decisions of
sports federations, sports of the sports associations, clubs against which there are empty or do
not exist means of legal protection.

25.3. Council of Sport Arbitration performs general supervision of the work of sport arbitration
court and offers legal opinions to the requests of the Olympic Committee of Kosovo or with the
proposal of the Kosovo sport federations, clubs and sports associations.

25.4. Sport Arbitration Court decides related on the request of the parties which are agreed
with competence of this court in disputes arising during sports activities, with the rights which
are available freely, if by the Law it is not determined otherwise.

25.5. With the internal acts the Olympic Committee of Kosovo regulates the competence,
composition, functioning, organization and procedure for Council of Sport Arbitration and for Sport
Arbitration Court.

Article 12

Article 26 of the basic Law shall be titled and the text of the provision shall be amended and
reworded as following:

Article26
Paralympics Committee of Kosovo, Deaf Sports Federation and Special Olympics of
Kosovo

26.1. Sports federations of people with disabilities join in the Paralympics Kosovo Committee,
respectively in the Deaf Sports Federation, while other institutions and legal persons in
order to practice of specific sports activities and recreational of the people with disabilities join
in Special Olympics Kosovo with the status of the National Sports Federation.

26.2. Categorized athletes with disabilities and the deaf, enjoy the right under Article 40
paragraph 1 of the basic Law.

Article 13

1. Article 33 of the basic Law paragraph 33.1. shall be amended and reworded as following:

33.1. Sports federations operate based on this Law and legislation in force.

2. Article 33 of the basic Law after paragraph 33.4. there is added a new paragraph 33.5. with the
following text:

33.5. Sports federations are obliged to conduct an independent audit at the end of each year.

Article 14

Article 40 of the basic Law paragraph 40.1. shall be amended and reworded as following:

40.1. Relevant Ministry for Sports in cooperation with the Olympic Committee of Kosovo
shall make categorization of sports and athletes with special rule according to International
standards.

40.2. Categorization of sports and athletes is based in the results achieved in the:

- Olympic and Paralympics Games;

- World Championships;

- European Championships;

- Balkans Championships;

- Mediterranean Games;

- Local Championship;

40.3. Categorized athlete is evidenced in the register of the categorized athlete and to the same
there is issued a written decision, against which can be appealed, complain in the relevant
Ministry for Sport within fifteen (15) days.

40.4. Relevant Ministry for the Sports finances the training of national team athletes to participate
in international sports competitions.

40.5. Manner of rewarding of the winners of national championships of Kosovo in the senior
category defines the relevant Ministry for Sport with sub-legal act.

40.6. With proposal of the Federation, the relevant Ministry for Sport share allocates scholarships
for Olympic hopes which are regulated by sub-legal act.

40.7. By the proposal of the relevant Ministry for Sport Government of Kosovo shall issue sub-
legal act to determinate valuation of rewards of the categorized athletes.

40.8. With the proposal of the relevant Ministry for Sport, the Government of Kosovo offers the
permanent financial support for athletes who have won medals at the Olympics Games, in the
world Championships, European championships.

Article 15

1. Article 50 of the basic Law paragraph 50.1. shall be amended and reworded as following:

50.1. The relevant Ministry for Sport shall, in particular way, supervise:

- fulfillment of conditions for the realizing of public interest with importance for the Kosovo
sport;

2. Article 50 of the basic Law other points of the paragraph 50.1. remain unchangeable in the
basic Law.

3. Article 50 of the basic Law paragraph 50.3. shall be amended and reworded as following:

50.3. The Supervising Body of the relevant Ministry for Sport in accordance with this Law
imposes disciplinary measures against individual persons and sports organizations.

4. Article 50 of the basic Law paragraph 50.4. shall be amended and reworded as following:

50.4. Establishment, composition and competences of the Supervising Body shall be determined
by sub-legal act.

Article 16

Article 51 of the basic Law shall be amended and reworded as following:

51.1. In order to realize the sports activities of students, school council in primary, elementary and
secondary school establishes school sports teams, without legal status, which use with priority
school facilities. School Council in primary and secondary schools organizes sports competitions
in cooperation with the Federation of School Sports.

51.2. Relevant Ministries for Sport and Education, with joint memorandum determine the manner
of establishment, duties, scope and financing of the organization of school sport and are obliged
for their implementation.


Article 17

Article 52 of the basic Law paragraph 52.2. shall be deleted from the text of the Law

Article 18

After Article 52 of the basic Law there shall be added two new Articles 52A and 52B with the
following text:

Article 52A
University Sport

52.1. Under the Kosovo Universities there can established students sports associations.

52.2. In order to realize the sports activities of the students, students council in faculties
establishes student sports teams, without legal status, which with the priority use university
facilities.

52.3. Student sports teams can establish sports university association.

Article 52B
Recreative Sports

52.1. Natural and legal persons may establish recreative sports clubs in order to take care and
improve the health.

52.2. Recreative sports associations can be established at least by five recreative sports clubs.

Article 19

Article 53 of the basic Law shall be amended and reworded as following:

53.1. Faculty of Sports Sciences prepares staff on training the sports staff.

53.2. Professional staff is considered individual persons which based on the relevant
qualifications creates the program, training of sports preparation, recreational sports and sports
education such as: coaches, persons qualified to work in sports, people who participate in
leadership and organization of sports competitions, sports judges, sports delegates, sports
controllers and sports managers.

Article 20

Article 56 of the basic Law shall be amended and reworded as following:

Ownership of sports facilities and environments shall be determined with the Laws into force.

Article 21

Article 61 of the basic Law, paragraph 61.1 shall be amended and reworded as following:

61.1. Health examination of participants in sports activities shall be performed by the doctor
specialist of sports medicine at Sports medicine centers licensed by the Ministry of Health.

Article 22

Article 63 of the basic Law shall be amended and reworded as following:
Government of Kosovo with the proposal of the relevant Ministry for Sport establishes Kosovo
anti-doping Agency.

Article 23

Article 64 of the basic Law shall be amended and reworded as following:

Organization, functions, responsibilities, organizational structure of Kosovo anti-doping Agency
shall determined by the sub-law act of the relevant ministry for sports.

Article 24

1. Article 65 of the basic Law paragraphs 65.1., 65.2. and 65.3. shall be amended and reworded
as following:

65.1. The basis of sport funding and public and state needs shall be comprised by financial
means that provided by the budget of Kosovo.

65.2. Municipalities of their budget shall appropriate funds for sport financing.

65.3. Action Plan for financing of sport activities with state public interest, based on the proposal
of the relevant Ministry for Sport, shall be approved by the Government of Kosovo.

2. Article 65 of the basic Law, after paragraph 65.5 there are added two new paragraphs 65.6 and
65.7 with the following text:

65.6. Olympic Committee and sports Federations are obliged to deliver the plan of activities and
annual financial plan based on request and deadline determined by the Ministry.

65.7. Relevant Ministry for Sport based on the degree of fulfillment of public interest shall
appropriate financial means for the Olympic Committee and sports federations.

Article 25

Article 67 of the basic Law, paragraph 67.2. shall be amended and reworded as following:

67.2. Tax facilities that natural and legal persons can enjoy, that sponsor sports activities,
organizations are defined by the law on sponsorship and donors in the field of culture, youth
and sport and in accordance with applicable law.

Article 26

Article 70 of the basic Law shall be amended and reworded as following:

70.1. Violent hooligan behaviour at sports fields open and closed that aims at preventing the
development of activities, shall be punished under the provisions of the applicable legislation.

70.2. Hatch deliberate of the results from the clubs, sports federations and other sports
stakeholders in order to benefit from the outcome of the ticking, shall be penalized under the
provisions of the legislation.

70.3. Intentional damage or destruction of the sports facilities open or closed by natural or legal
persons, shall be punished under the provisions of the applicable legislation.

70.4. Sports competitions of official nature shall be ensured by Kosovo Police. This activity of the
Police shall be compensated according to the legislation into force.
Article 27

Article 71 of the basic Law shall be amended and reworded as following:

Keeping and use of firecrackers and weapons of all kinds in sports facilities and in sports
environments open and closed, shall be punished under the provisions of the applicable
legislation.

Article 28

Article 76 of the basic Law, paragraph 76.1: a fine in the amount foreseen from‘’ one thousand
(1.000) to five thousand (5.000) Euro’’ shall be amended into the fine in the amount of ‘’ three
thousand (3.000) to seven thousand (7.000) Euro’’.

Article 29

Article 77 of the basic Law, paragraph 77.1 shall be amended and reworded as following:

77.1. With the fine of two thousand and five hundred (2.500) to five thousand (5.000) Euro, there
shall be punished the professional person who obliges the athlete to train or participate in sports
competitions when he is not able because of an injury or illness.

Article 30

Article 78 of the basic Law, paragraph 78.1 shall be amended and reworded as following:

78.1. With a fine of five thousand (5.000) to ten thousand (10.000) Euro, there shall be punished
the person who gives or use stimulating preparations which are prohibited and harmful to health.
Such persons shall be punished even with the prohibition of exercising the profession for a
certain time from one (1) to three (3) years.

Article 31

Article 79 of the basic Law, paragraph 79.1 shall be amended and reworded as following:

79.1. With a fine of two thousand and five hundred (2.500) to five thousand (5.000) Euro, there
shall be punished the organizer of competitions and sports performances, which does not provide
medical personnel to help them during the developing of sports competitions or sports
performances.

Article 32
Final Provisions

Article 81 of the basic Law shall be amended and reworded as following:

81.1. With the approval of the Law on amending and supplementing the Law on sport there are
repealed the previous provisions of law on sport 2003/24 in Kosovo in the points, where is made
amendment and supplementation, as well as the sub-legal acts which are affected by these
amendments.

81.2. With the approval of the Law on amending and supplementing the Law on sport and
after the approval of the of relevant sub-legal acts, there are repealed sub-legal acts issued
under the previous Law: Administrative Instruction no.01/2005 for the Establishment and
Registration of Public and Private Clubs of Sports, Administrative Instruction no. 02/2005
for Registration and Licensing of Sport Federations and Associations, Administrative
Instruction no.03/2005 for Institutions sports Medicine, Administrative, Administrative Instruction
no. 04/2005 for the Organization and Functioning of the Kosovo Olympic Association as well as
Administrative Instruction no.05/2005 for supervision of administrative and professional work in
the clubs and sports Federations.

Article 33

Article 82 of the basic Law shall be amended and reworded as following:

Sports organizations and other subjects should within six (6) months to make the harmonization
of their normative acts to amendments and supplementation of this Law.

Article 34

Article 83 of the basic Law shall be amended and reworded as following:

83.1. Relevant Ministry for Sport makes supervision of implementation of the Law on Sport
No.2003/24 and implementation of this Law.

83.2. Relevant Ministry for Sport should, within six (6) months, issue sub-legal acts under the
provisions on amending and supplementing this Law.

83.3. Institutions affected by this Law, according to budgetary possibilities allowed by the Law on
Annual Budget shall meet their obligations.

Article 35


This Law shall enter into force fifteen (15) days after publication in the Official Gazette of the
Republic of Kosovo.
